JUST RESEIVED A LETTER FROM A LAWYER CONCERNING A FSLA LAWSUIT FOR FF, LT'S AND CAPTAINS, DOES ANYONE KNOW WHAT'S FOING ON? IS THIS LEGIT? IS THIS THE SAME AS THE PARAMEDIC LAWSUIT? THANKS

am a member, been paying dues for 36 years. kicked off concerns another issue, so if someone can fill me in on what is going on with this FLSA stuff it would be appreciated, should we or should we not take part in this.

25's, glad to see you back posting. Don't know much but it's a FSLA suit a couple of years old pertaining to OT not being paid in a timely fashion as mandated by the "contract". This is for the period of 2007-2009 when you were "active". According to the posts about 200-300 are in the suit. Whats interesting is the "Illustrious Leader" wants you guys to hold off a week while he checks with the Locals attorneys? Stay safe Brother,Jake

Hi Jake, paying overtime in a timely manner is not in the contract, it's federal law. Hence, the lawsuit. Glad to see that we're still kicking the city in the balls as they feel they are above the law.

Actually the Federal law for overtime says that all hours over 40 must be time and a half. Any other monies must be calculated in the ot. Say a person makes $10 an hour and gets 10% night differential. That person would get $10 times 40 hours or $400 plus $40 for the night shift. That would mean all ot must be calculated at $440 divided by 40 or $11 per hour. Thus, 1 hours ot would be $16.50 per hour and not $15 an hour. Even if you worked nights and then the ot was a day shift, you are still entitled to the extra money of $16.50 an hour not $15 an hour. As a union rep, I discovered this and grieved it to the NLRB. Our union won millions for its members. Stay safe !!!

This suit is probably a "slam dunk" for the litigants. Just like the last suit by the Medics. The problem is that Neuter ignores these decisions in the courts and is getting away with it. Politics at the higher levels seems to be allowing it. Wouldn't it be neat if a Judge with scroats subpeoned him and locked his ass up. We always talked of "Slippery Ed" & his cohort Cohen , this guy seems to be the "Teflon Man"and is getting away with this BS. Stay safe,Jake
